Xarelto Litigation Update

There are now over 7000 Xarelto lawsuits consolidated for Multidistrict Litigation in the US District Court for the Eastern District of Louisiana. Frohlich, Gordon & Beason, PA., represents several of the Plaintiffs whose cases have been consolidated in the Eastern District of Louisiana.

The lawsuits filed against the manufacturer of Xarelto and the co-marketer allege that these companies failed to warn patients and physicians of the increased risks of fatal internal bleeding when using Xarelto.

The judge overseeing the litigation has selected several cases that will be tried as the "bellwether trials."

The outcome of each bellwether trial is not binding on other lawsuits in the MDL. Rather the purpose of the bellwether trial is to give the attorneys on both sides a benchmark to determine the value of certain injuries during settlement negotiations.

The first trial, slated to start in February, involves claims that Xarelto caused a Louisiana man to develop gastrointestinal bleeding, according to an order Friday from U.S. District Judge Eldon Fallon in the Eastern District of Louisiana.
